Preliminary Hearing to be Held July 6-10

The preliminary hearing in this case is scheduled to begin on Monday, July 6, 2026, and continue through Friday, July 10, 2026. Proceedings will begin at 9:00 a.m. MDT with the exception of Wednesday, July 8, 2026, when the proceedings will begin at 1:00 p.m. MDT.

The purpose of the preliminary hearing "is limited to determining whether probable cause exists." Utah Const. art. 1, § 12. The prosecution bears the burden of demonstrating probable cause. See State v. Lopez, 2020 UT 61, ¶ 46, 474 P.3d 949. The probable-cause standard requires “evidence sufficient to support a reasonable belief that an offense has been committed and that the defendant committed it.” Id.

If the prosecution presents sufficient evidence to satisfy the probable-cause standard, then the defendant will be bound over for trial. See id.
